Best&Less Colouring competition

Full Terms and Conditions

  1. This competition is promoted by Best & Less Pty Limited (ABN 29 003 724 696, hereinafter “Best&Less”). Participation in this competition is deemed acceptance of these Terms and Conditions.
  2. The competition includes the chance to win one of forty Best&Less gift cards valued at $50 and the chance for your child’s day care centre or pre-school to win one of three facility Makeover Packages valued at up to $10,000.
  3. Eligibility:
  4. To be eligible to participate entrants must enter via the Best&Less Colouring competition web form (link location: bestandless.com.au/colour-me-happy) provided to customers via QR code in the Best&Less “Colour Me Happy” colouring books and advertised on the Best&Less owned channels.
  5. Entrants must be an Australian resident aged 18+ and must not be an employee, contractor, agent or otherwise affiliated with Best&Less or connected to the Competition in any way. Entry into the competition is free (except for any normal internet or mobile connection charges that may apply).
  6. How to enter:
  7. Entrants must enter their contact details and submit a photo of their child’s colouring in from a Colour Me Happy colouring book via the competition form online. Entrants also have the option to enter their nominated day care or Pre-school if they wish to enter the Makeover Package competition. Entries will be completed via the following link bestandless.com.au/colour-me-happy.
  8. Entrants can enter as many times as they like, however each colouring in drawing can only be submitted once during the entire Competition Period.
  9. By entering, the entrant gives Best&Less the usage rights to their colouring in photo, allowing Best&Less to share or repurpose the image and its likeness across all earned, paid and owned channels (for example: posting the colouring in photo on Best&Less Facebook or Instagram pages).
  10. Key dates GIFT CARDS:
  11. The opening date for the competition is 12:00:00am (AEDT) on 13 January 2022 and the closing date is 11:59:59pm (AEDT) on 23 March 2022 (“Competition Period”). The Competition Period is made up of four (4) separate prize draw periods (“Prize Draw Periods”), which are:
    1. Prize Draw Period 1: All eligible entries received from 12:00:00am (AEDT) 13 January 2022 to 11:59:59pm (AEDT) 9 February 2022 will be included in the prize draw. DRAW DATE: 9:00:00am (AEDT) 11 February 2022.
    2. Prize Draw Period 2: All eligible entries received from 12:00:00am (AEDT) 10 February 2022 to 11:59:59pm (AEDT) 23 February 2022 will be included in the prize draw. DRAW DATE: 9:00:00am (AEDT) 25 February 2022.
    3. Prize Draw Period 3: All eligible entries received from 12:00:00am (AEDT) 24 February 2022 to 11:59:59pm (AEDT) on 9 March 2022 will be included in the prize draw. DRAW DATE: 9:00:00am (AEDT) 11 March 2022.
    4. Prize Draw Period 4: All eligible entries received from 12:00:00am (AEDT) 10 March 2022 to 11:59:59pm (AEDT) 23 March 2022 will be included in the prize draw. DRAW DATE: 9:00:00am (AEDT) 25 March 2022.
  12. Key dates DAY CARE/PRE-SCHOOL MAKEOVER PACKAGE:
  13. The opening date for the competition is 12:00:00am (AEDT) on 13 January 2022 and the closing date is 11:59:59pm (AEDT) on 23 March 2022 (“Competition Period”).
  14. All eligible entries received during the Competition Period will be included in the Makeover Package competition. WINNER SELECTION: 9:00:00am (AEDT) 25 March 2022.
  15. Prizes:
  16. There will be ten (10) AUD $50.00 Best&Less gift cards per Prize Draw Period to be won. Gift cards are drawn at random and awarded to ten individual entrants per Prize Draw Period. A total of forty (40) gift cards will be awarded for the Competition Period.
  17. There are three (3) $10,000 day care or pre-school Makeover Packages to be won during the Competition Period. The day care or pre-school Makeover Package will be awarded to the 3 day care or pre-school centres who receive the most nominations during the Competition Period. The Makeover Package awards each winning day care or pre-school the opportunity to have their facility newly painted, to the value of $10,000. The $10,000 includes the cost of the labour and materials. The scope of works will be negotiated with each winning facility and completed by external suppliers selected by Best&Less..
  18. The total prize value is $32,000, divided between the game of chance and game of skill competitions.
    1. The total value of the gift card prize draws is $2000. The gift card prize draw is drawn four (4) times during the draw period. The 4 separate draw dates are noted above in “key dates”.
    2. The total value of the day care or pre-school Makeover Package prizes is $30,000.
  19. Winner selection – GIFT CARDS: The gift card competition is a game of chance. Skill plays no part in determining the winner. The draws will take place on 11 February 2022, 25 February 2022 ,11 March 2022 and the 23 March 2022 at 657-673 Parramatta Rd, Leichhardt NSW 2040 and will be drawn from all entries received during the Competition Period (each a “Winner”). Each Winner will be notified by email by the following Friday after the draw period and provided with a unique digital gift card for use online or in-store. The Winners will be published online at bestandless.com.au/colour-me-happy. The prize must be claimed within three (3) months of the draw. If the prize is not claimed by this date, an unclaimed prize draw will be carried out in the following month. Winners can only win one (1) prize during the Competition Period. If any person first chosen as a Winner is found to be ineligible, including past winners, they will be disqualified and another entrant will be selected as a replacement winner.
  20. Winner selection – MAKEOVER PACKAGE: The day care or pre-school Makeover Package competition is a game of skill. The 3 day care or pre-school centres that receives the most nominations during the Competition Period will each win a major prize. Winner selection will take place on 25 March 2022 at 657-673 Parramatta Rd, Leichhardt NSW 2040 on the basis of the most entries received during the Competition Period (each a “Winner”). Each Winner will be notified by phone by the following Friday after the winner selection. The Winners will be published online at bestandless.com.au/colour-me-happy . The prize must be claimed within a month (1) months of the draw. If the prize is not claimed by this date, the unclaimed prize will be awarded the following month to the day care or pre-school centre with the next most number of nominations. Winners can only win one (1) prize during the Competition Period. If any centre first chosen as a Winner is found to be ineligible, including past winners, they will be disqualified and another centre will be selected as a replacement Winner. In the event of a tie for the Makeover Package, a panel of judges selected by Best&Less will assess the entries on the basis of artist merit to determine the Winner. The decision of the panel judges will be final and no correspondence or discussion will be entered into.
  21. Costs and expenses – Entrants will be responsible for all costs in relation to entering the competition and redeeming any Prize.
  22. Modification of offer - Best&Less reserves the right to modify, discontinue or extend this competition at any time. The Prize is non-refundable, non-transferable and subject to availability. No warranty or guarantee is given as to the quality of the Prize and in relation to the Makeover Package to the suitability or quality of the external supplier’s work. No cash or Prize alternatives are available. However, Best&Less reserves the right in their reasonable discretion to substitute the Prize with another Prize of equal value in the unlikely event that the Prize becomes unavailable. If the Winner is unable to take the Prize as stated, the Winner will forfeit the Prize and no payment or compensation will be made in lieu.
  23. Privacy - Any personal information entrants provide will be used solely for this Competition and will not be passed on to any other parties without consent. Best & Less privacy policy can be found at bestandless.com.au/privacypolicy.
  24. Disqualification - Best& Less reserves the right in its sole discretion to disqualify any entrant if it has reason to believe the entrant has breached the Terms and Conditions. Best&Less’ legal rights to recover damages or other compensation from such an offender are reserved.
  25. Legal – Entrants enter the Competition at their own risk. Under no circumstances will Best & Less Pty Ltd be responsible for any loss, damages, costs or expenses arising from or in any way connected with any personal injury, loss or damage, errors, defects interruptions, malfunctions or delays connected to or as a result of the Competition or any Prize including the Makeover Package. Entrants unconditionally and irrevocably release and discharge Best & Less Pty Ltd from any liability in relation to this Competition including but not limited to any liabilities suffered by Best & Less Pty Ltd arising from any claim. Once the Prize has left the premises of Best & Less, responsibility for any damage, delay or loss to the Prize during transit will pass to the Winner.
  26. Jurisdiction - Any dispute relating to this Competition shall be governed by the laws of New South Wales and subject to the non-exclusive jurisdiction the courts of of New South Wales.
